Because of this, Now I know the reason why in th

Wells Fargo home mortgage did what to your family, and who did the va loan department tell you to negotiate with, are you serious? you have been paying on your loan for 15 years, and they said wells doesnt offer hamp???? what

Because of this        , Now I know the reason why in the middle of a modification workout that was arranged, someone also didn't look at the date, and my home went to sale, a realtor showed up at my door, and said you need to make arrangements to leave, Wells Fargo no longer owns this property! Imagine the horror of this, its wintertime in alaska -25 below zero and I have 30 days to move 16 years of accumulation of my life, because someone didn't read the dates, do you know how much money this cost my family and still now, you all say why are you behind on your mortgage! I want the public to know that for 2 !/2 years you people took to finally give me a modification arrangement I want the public to know that after I left, my family kicked out in the middle of winter with no-where to go, you have the odasity to tell me for two years to fax paystubs every 2 weeks to you all, and then you don't cancel the sale, and lied to us saying" you never had to move out", wells fargo is still the mortgage co. well then I get outraged when the Veterans administration, sends me a copy of the cancelled check they sent you and you cashed and hurried up and sent them a check back for the same amount, hush hush type deal. When I told the modification dept. this they couldn't believe it I swear I could of heard a pin drop in the background, you, think after giving you 250,000. in payments over 16 years you could possibly give my family the time of day, hell no I have not heard back since, and now I have the president of wells fargo H>M> sending me a letter, saying inaccurate info. And my home is scheduled to be sold in 11 days, I have 100,000 equity and I am furious with you people! You need to pull your head out, and show some humanitarian effort on your part, this can not happen to people who have been customers for many many years!! I'm waiting to hear from someone soon.

AND YOU RELY ON OTHER CO-WORKERS TO READ THE DOCS, WELL DOESN'T LOOK LIKE THEY DID EITHER, CHECK OUT THE UNEMPLOYMENT FIGURES, I'LL TELL YOU WHAT, THERE ARE PLENTY OF PEOPLE OUT THERE THAT CAN DO YOUR JOB , ALL THEY NEED IS EYES. THE PEOPLE THAT HAVE THOSE JOBS NEED TO BE THE ONES UNEMPLOYED, DROP THEM ALL FROM THE PAYROLL, OBVIOUSLY THEY DON'T GIVE A SHI- ABOUT ANYONE, HOW DARE YOU PASS THE BUCK LIKE, OH WELL. I WONDER HOW MUCH INTEREST YOU HAVE MADE OFF OF MY FAMILY AFTER 16 YEARS, OFF EVEN THE INTEREST I'VE PAID, NOW TIMES THAT BY HOW MANY GOOD PEOPLE YOU ARE SCREWING IN THE PROCESS, WELL I CAN'T COUNT THAT HIGH. AND YOU WANT TO NEGOTIATE. OH, UPPERCASE I'M USING IN CASE YOU FORGOT YOUR GLASSES AND SCREAMING INCASE YOU TURNED YOUR MIRACLE EAR DOWN!

YOU JUST MADE MY DAY MCSPOCKY:

I COULDN'T FIGURE OUT HOW TO LINK THIS TO THE RIGHT DIRECTION. I REALLY DON'T WANT TO make it seem like I am into just myself but let me tell you, all the story's I have heard about the foreclosures and banks, don't even come close to the extorsion and crap I have endured and am still enduring, they are still trying to get me to sign a loan mod, hush hush type, for 102,000, and I do not want to give them another dime, I really want a lawyer, but I think I need the public to help me decide, everything I said is the truth, the experience has overwhelmed me to the point I want to just give in, but that is not me, I won't compromise what is right, can you help with any ideas, I've got 18 years invested and they have taken everything I had from my construction business, and made me sell my possesions to give them big lump sums of money, and then they never applied it to any part of the loan, I have copies of all transactions.

I am a New Yorker and have strongly protested this administration's attack against our Attorney General. He was the last hold out for what the banks wanted. He would not let them do a hurry up and foreclose so the banks could then rent out the property. I guess they would become the new slumlords. This administration was going to let the banks rob homeowners of their equity and then make money renting the property. New York State Attorney Generals have a history of protecting its citizens. This includes our current governor who was the Attorney General before becoming governor. The Federal Attorney General office could take a lesson on consumer protection from Mr. Schneiderman.

Banks are the experts, the professionals not home buyers. If the professionals caused this crisis, why do the home buyers have to pay? What did they, the professionals do with the funds given to them to help people refinance their mortgages? When do the people receive their bailout? Where is the consumer protection?

This family was literally left out in the cold to one of the crooks who caused the crisis, realtors and mortgage banks. Yet no one is made accountable and the practices continue.

lots of people write stories about their own situation, I don't see anything wrong with that. But doing so for personal gain (like say donations), that would be a violation. Is there something I am missing about the CoH or ToS?

I have no clue, I write so few articles that I don't really pay much attention to that. I write so few because they don't get the traction/visitation that others do. I mean, hell, why should I spend the time to try and write something thoughtful and hopefully balanced, get less than a hundred comments over a month, when I could just write some politically motivated flamebait based on lies and get more than a thousand in a couple of days. I can't write the flamebait, so I tend not to bother.

Putting in HTML tags might help if you know how to design web pages.

As far as this article is concerned, if you did want to expand it, you may want to see if this is a widespread problem. This may after all just be a matter of an individual within one of those organizations doing something illegal for personal gain, which doesn't make it right, but it would limit the number of people impacted by it.

To me, what seems REALLY strange is that they sold your place before foreclosure. That just doesn't make sense to me. (at least, that is the way I read it). As to the sale itself, if you can prove that the sales agent didn't have legal title to sell the place, then the sale itself is void. You really would need to talk to a lawyer about that though as the specific details do vary from state to state.

I am going through my own personal situation where one of my homes was fraudulently mortgaged, and it has been stated VERY clearly to BofA that they can't do anything with the home until that has been resolved. Now my situation is different though because it was something that happened to a bunch of people from the same mortgage broker office, so there was definitely something criminal going on. That is why I mentioned that you may want to investigate if this is something that has happened to others, if so, how widespread, is there a common factor etc...

I know this is hard, especially in your current situation, but being calm and collected about it is something that you should strive to maintain. If composure is maintained, then you are more likely to get people who can make a difference to listen to you. (yes, as I said, I know it is very hard sometimes to do that). I've also been known to do some ranting, (some of my comments from yesterday on a medical situation cover that pretty nicely), but when it comes down to how I am dealing with it from a legal and professional sense, calm and collected is the way to go.

Thanks for your advice, this story is so complicated and so many fingers in the pie, I cant even explain to an attorney I have, but they are not interested in hearing one persons troubles, it has scam all over it, and thatsputting it lightly, the damages they done to the property, just everything, I am not asking for a bailout just, for justice, they are letting my property slip thru the cracks of injust.

Well unless an attorney is trying to angle for a class action lawsuit, if you retain a lawyer, then that lawyer should be all about your case, and no other case, when they are talking to you.

Maybe you just need to write everything down, try to organize it properly, and then present that to your attorney, instead of just trying to explain it in words. The lawyer might just be not hearing what is happening because it is disorganized.

I am not sure how much time, or ability (I don't mean this in an insulting way because not everybody has this ability, which is why some writers are great, and some are just crap) in this you may have to devote to it, but taking a couple of weeks to collect and organize your thoughts rationally just might be the biggest help you can give yourself.

Do you have a lawyer? Can you afford one? I watched a video today and it is the same old story from the right. I know you work and have children if I am reading this properly. I keep hearing the same story, the same nightmare, over and over again. I am hoping for the best for you and your family.

Jonathion is dead on when he said: To me, what seems REALLY strange is that they sold your place before foreclosure. That just doesn't make sense to me. (at least, that is the way I read it). You need to get all of your ducks in a row by a chronology of the dates, people involved, and results, and then get a lawyer with the clear understanding that this is in no way a class action suit for you need restitution now not in another year. If you have a problem with getting one I don't know about Alaska but most bar associations will provide legal aid if you need it. Get the local print and electronic media involved because this is the sort of thing that they all go for--taking on the corporate nasties doing harm to the locals. Good luck and please keep us advised.

Sounds like a nasty criminal fraud case is in order here.

To be honest, I thought that the bank would have to first foreclose, which means that the previous owner has been removed from the premises before the property was resold. If the original owner is still living in the place, then they had no right to sell the property, while they may have the lien, they wouldn't possess title.

You poor wonderful soul. I can not imagine especially in your state in such harsh conditions. Are your children alright? There are so many stories like this going on across this country. I know you are not allowed to legal talk about any of this. That is to protect the bank, not you. I was ripped off for a smaller amount. In the settlement, I got a fraction of what I paid for the product and was told I could not tell anyone what that company did to me. During the Bush years, all the protections were removed to protect consumers. Companies are protected in every possible way. I personally watched the bankers and wall street types yelling and have a huge party after he won his second term. They kept saying they had the right to legally steal now.

You should see Florida. Home after home is empty. Windows and doors boarded up. There are forsale signs everywhere. This President has been trying to get a Consumer Protection Agency in place (remember Elizabeth Warren). She was blocked by congress so the President put her assistant in her job a few weeks ago. I bet money her assistant is likely running into the same walls while congress refuses to fund them. I know that congress is playing a huge role in making sure this does not see the light of day. So many veteran are coming home to the similar situations. This was an intentional rip off by Wall Street and no one will be accountable.

Do you know who owns the deed to your property? I watched a story about a family that owned their home outright. They were told their home was sold and had to move out. How could that happen? They paid the home off. It cost them money and they won because they had the deed. Now they are telling people unless someone shows you who owns the deed, not to pay or leave. Ofcourse, I do not know what that will get you except having a police man showing up.

I would be screaming my lung out and would not care what they say. They want you silent so they can do whatever they can legally and get as much money as possible. I wish I was a lawyer and could help you. I really do. I would still let people know what is happening.

I have seen more people here in Florida just walk away from beautiful homes. They are told to leave, or their interest went through the roof while the value dropped. BOA has played a huge role in this. So many people played a role in this which is why there are so many 99 percent people out there. I hear they are getting involved and going to homes to keep banks from kicking the owners out.

I know you have been told not to legally talk to anyone but please keep us informed. We all need to know the tricks being played against us. I would like to know more about the contaminated water, garage, etc. Can you explain how that happened?

Thanks for reading my article, the truth the whole truth and nothing but, so to say and theres more to tell, I learned late in life that trust is never given it is earned, so now I find it so hard to trust anyone, to think the loan dept at va would file an abandonment on the property, when they found out I was visiting my mom in florida who I would check on finances thru trust account, he wanted to know the attorneys name, I asked the manhow old he was as even thou I spoke with him the conversation to me we had together told me he was not a homeowner and or a veteran and was just learning his life lessons, I told him that he could cancel postpone the sale as It would be better for me to stay in the property as I was still fixing the damages that were caused by their people, I stated my husband is a veteran, you are not, my husband still has the trust of the usaas he is one of the few, to be able to transport brand new billion dollar tanks to the bases for them, a job that is not an easy one, takes alot of skill, he still is connected, and by god you can do this for him I stated, he was silent and said okay I will see what I can do, he did one more time while we waited for wells fargo's decision, that never seeme appropriate as who wants to pay free money for a mod, what, thats crap, then the document states that after the money is sent to them, which the mod was totally rediculous, they would send us the fine print details on the note, thats crazy, I told him I dont dislike my husband enough to torture the man, I never accepted the modification they offered at the time, and I then asked about the hamp program, they said they didnt have it to offer yet, why I said, no answer, I then started getting several calls from people that didnt speak english, at all, they asked about loan numbers and information and said they were from wells fargo h.m. and they didnt know my husbands social the loan number, and I certainly was not going to tell them, I have saved those messages a few of them anyway, creepy, I'll tell you, my husband did his time as a young man in the service, he deserves much more respect than that awful bank gave to him, we put hundreds of thousands of dollars in that bank, over 16 years because we had a contracting/business and they didnt even know our name, except when we closed our bank accounts and went elsewhere they had the nerve to say, when are u coming BACK TO US, i SAY TO THEM,

WHEN HELL FREEZES OVER THATS WHEN, WHAT DISRESPECT, AND I WILL SAY ANOTHER THING, WE THE PEOPLE ARE THE THE LARGE AND IN CHARGE, SO WHOEVER THINKS THAT ISNT TRUE, IS SADLY MISTAKEN, WE THE PEOPLE COULD MAKE OR BREAK ANYN INSTITUTION IN THIS WORLD IF WE ALL STOOD TOGETHER AND SIMPLY SAID WE ARENT TAKIN YOUR CRAP ANYMORE, THIS IS WHAT WE WANT,

HOW ABOUT THAT, I SAY THERE IS MORE POWER IN THE PEOPLE THAN WHAT WE ALL GIVE OURSELVES CREDIT FOR...... JUST SAYIN. OH and by the way I was not screamin,

thanks for listening, cause my government isnt, sad that I have never asked for nothin like this, and cant get the help with justice, but I would have they're back in a minutes notice. But see thats where the good guy finishes last, huuum.

Unfortunately this is just how the banks will do you when you are a good long standing customer with 100k in equity. The dream of owning your own home outright is actually better served by never having any equity in your home at all. Anyone who has a large pile of equity in their home but still owes the bank is at risk to lose everything they have.

The sad reality is when you have a lot of equity in your home you are the first person a bank would like to foreclose on. All of that value and equity is like a big cookie jar to them and by the time you get into trouble and need some help you are already screwed because they never help anyone who has a lot of equity. They have to steal your equity and make a quick buck. That is just the way it is.

If you had borrowed against your home, refinanced all of the money out of it and made foreclosure extremely costly for the bank they would bend over backwards to keep you in your home so they don't lose a fortune on the place. Also you would have a large pile of cash socked away in the event that bad times occur you could make your house payments with your cash savings. If you got too far under water you could actually buy another home and walk away leaving the bank holding the bag.

I read a book that said all of that at Barnes and Noble one day in a big cushy chair. I was amazed at what a different perspective it was but have found those observations to be spot on.

Its warmed up to 15 below zero, this is the coldest winter since 1969, I'm really sick of that because of the fuel costs too

Here on the East Coast we are having another fine temperate winter. It's a cool 40 some most of the time with highs in the 50's occasional. (:

When I go back to fishing in Alaska I am going to freeze my butt off.

They have to steal your equity and make a quick buck. That is just the way it is.

Not necessarily. There are state laws that say a homeowner has to be given any proceeds received over and above the amount due the bank in a foreclosure sale (surplus proceeds). So, banks cannot "steal equity" in those states.

I don't know if Alaska is one of those states that have that law.

Stopping bankers from stealing money is like playing "Whack -a-mole," they have all kinds of fees for all of the services required to foreclose. Service fees, eviction fees, sales fees, fees for processing all of the fees, fines for not paying the fines, penalties, and a whole lot more. They can rob you so blind you will be lucky to escape with your birthday and a change of clothes.

    verbal.

the market is so screwed up right now that the bank will just often sell in a block for a much much lower price than the assessed value (which is really just for property taxes anyways), which ends up screwing the homeowner.

    Hello ALASKABRAT

I am so sorry about your predicament. I am not a lawyer but from what little, I have heard about your situation. I would be finding myself a damn good lawyer. Here is where I would start

    American Civil Liberties Union

Alaska | American Civil Liberties Union

You may not find a totally free pro-bono lawyer but you have a good chance of finding a great lawyer who is really dedicated to your cause beyond the fiscal composition. I hope this maybe some help. My prayer and best wishes that things work out for you and your family. David
